Public Liability
The insured's legal liability to third parties to pay compensation in respect of death, illness, personal injury and/or property damage occurring during the period of insurance as a result of an occurrence and happening in connection with the business or caused by any of its products.
This policy covers the legal liability of the University in respect of activities anywhere in the world. Negligence by the University must be established. In the legal sense this means the omission to do something when a reasonable person, guided upon those considerations which ordinarily regulate the conduct of human affairs, would do, or doing something which a prudent and reasonable person would not do.
NB: Any occurrence which could potentially lead to a claim must be reported immediately.
Coverage extends to employees, volunteers, Council members, Board and Committee Members and students of the University in their official capacity for the University.
Interest insured
Insured's Legal Liability to pay compensation in respect of:
- Injury to any person
- Damage to property
Happening during the Period of Insurance and caused by an occurrence and/or accident within the geographical limits in connection with the business and its products.
Insurer will also pay:
- All costs and expenses incurred with the written consent of the Insurer.
- The Solicitor's fee for representation of the Insured.
Geographical Limits
Anywhere in the world, with the exception of:
- Personal Injury or Property Injury caused by or arising out of University Products knowingly exported by the University, or our agents or servants, to the United States or Canada.
- Claims made and actions instituted within the United States of America or Canada or any other territory coming within the jurisdiction of the courts of the United States of America or Canada. (This exclusion does not apply to claims and actions made in relation to the insured who is involved in Non-Manual work or is supervising work and is resident outside of the United States of America of Canada.)
